Structural Tests and Special Inspections

Chapters 17, "Structural Tests and Special Inspections" governs the testing and special inspections of structural components of building and the systems in those buildings (HVAC, plumbing and electrical). The special inspections will usually be done by Licensed Professional Engineers different from the Architect-of-Record and Engineer(s)-of-Record for the project and as determined by the Authority Having Jurisdiction. Contractors should be familiar with the following sections of Chapter 17:
· Section 1705 calls for special inspection in seismic zones C, D, E & F for HVAC duct systems carrying hazardous material; anchorage of ductwork carrying hazardous material; piping systems containing hazardous material and electrical systems & equipment for emergency or standby power systems.
· Section 1707 calls for periodic special inspections for HVAC of both the duct systems and anchorage of duct systems carrying hazardous materials; piping systems containing hazardous material and electrical systems & equipment for emergency or standby power systems.
· Section 1708 outlines the requirements for seismic qualifications of mechanical and electrical equipment.

HVAC
On June 9, Tim House, HVAC Division Director, presented to the Interim Joint Committee on Licensing and Occupations legislative proposals on behalf of the Kentucky HVAC Board. These proposals would affect the existing licensing procedure by removing language that states the applicant for a master license, "Has been regularly and principally employed or engaged in the heating ventilation and air conditioning trades as a journeyman heating-ventilation and air conditioning mechanic for not less than two years under the direction and supervision of a Master heating, ventilation and air conditioning contractor, and Passed an examination prescribed by the Board to determine competency to practice heating, ventilation and air conditioning."
And delete language for the Journeyman license that states: "Has been regularly and principally employed or engaged in the heating, ventilation and air conditioning trades for not less than two 2 years under the direction of a master heating, ventilating and air conditioning contractor and Has passed an examination prescribed by the Board to determine competency to install, maintain and repair heating, ventilation and air conditioning equipment."
The proposal would add in this new language for both Master and Journeyman. "Posses all other qualifications, which may be, prescribed by administrative regulation of the KY Board of Heating, ventilation and air conditioning contractors."
The deletion of the old language and the addition of the new language would supposedly give the HVAC Board more flexibility. Director House told the legislative committee during his presentation that " The attached amendment proposes to authorize the Board to establish specific requirements for qualified, experienced applicants coming to Kentucky seeking work in the HVAC profession." He also stated that, "The only downside identified regarding this legislative amendment is that increased competition amongst existing qualified licenses may result."
Another proposal dealing with journeyman licensing would give more flexibility to the Board in extending time for renewal. Director House stated to the Board that, "The burden borne by the licensee who does not renew within 90 days of the renewal period is punitive and excessive."
The only comment received from the legislative committee concerning HVAC was made by Senator Tapp, who surmised that this would open up the grandfather period.
The only other comment was by Senator Robin Webb discussing the many negative comments she has received about high costs of water heater installations. She suggested that the Division of Plumbing review its policy in an attempt to "still provide public safety but not be so onerous with costs." She expressed concern that costs were causing "people to go across state lines" to purchase water heaters. Director House explained that permits cost $45. And "if it was financially possible, we would do water heater inspections for nothing."
